Federal appeals court in Sao Paulo suspends injunction that shielded MercadoLibre from Anatel telecom rules

On February 27, 2026, the TRF-3 federal appeals court suspended a lower-court injunction that had excluded MercadoLibre from Anatel's prior inspection of telecom products and from joint liability for uncertified goods sold by marketplaces. The suspension stays in place until the final ruling in the case, so the marketplace must now operate under Anatel Resolution 780. The Attorney General's office had asked for the suspension.

  • Court: TRF-3, decision of February 27, 2026
  • Suspended injunction had exempted MercadoLibre from prior inspection and joint liability
  • Anatel Resolution 780 (2025) makes marketplaces share responsibility for uncertified telecom products
